DECREE

Decree N°2004- 459 of 7 June 2004 modifying the decree N°2003- 1389 OF 31 December 2003 relative to the security pf pools and modifying the code of construction and habitation.

Art 1. The article 128-2 the code of construction and habitation is composed thus : 1 The owners of pools constructed or installed from 1 January 2004 must have equipped them with a security system intended to prevent drowning, at the latest when it’s filled with water, or if the works to install the ssystem require water earlier, at the latest by the end of the pool works

The system consists of a protective fence, a cover, a pool shelter or an alarm meeting the following security demands : The protective fences must be constructed or installed in such a way as to prevent passage of children of less than five years old without the help of an adult, to stop children less than 5 years notably as regards to the system of locking of the access and not causing injury.

The covers shoul be constructed and installed in such a way as to prevent involuntary immersion of children of less than 5 years old and to resist the weight of an adult without any injury.

The pool shelter should be constructed or installed in such a way as not to cause injury in such way that when closed the pool is inaccessible to children less than 5 years old.

The alarms must be constructed or installed in such a way that the control panel for activation or deactivation cannot be used by children of less than 5 years old. The detection systems should be abble to detect movement by a child of less of 5 years old and activate an alarm alert in the form of a siren. This siren does not have to sound for unnecessary reasons.

The standards systems are presumed to satisfy the demands directed in II or to the standards or technical specifications or to the manufacturing process in force in a member state of the EU or another state party to the Eurpean economic agreement on space assuring an equivalent level of security. The references for these standards are published in the Official Journal of the French Republic.

The owners that is to say he who decides the construction or the installation of a pool, calls on a constructor or installer, this last person must hand over a technical note at the latest at the date on the complition of the pool :

• which indicates the characteristics, operating conditions and maintenance of the security systems chosen by the owner
• Which informs him about the risks of drowning, on the general measures of prevention to be taken and on the recommendations attached to the use of the securtity systems.

RESPONSABILITY

As a retailer, we have an obligation to provide information to our customers. It is for this reason that the company CSL has identified as a unique product the mesh security fence THE BEETHOVEN. In effect, for the owners of pools with children or who often receive their grandchildren from 1 to 6 years old the fence is a safety product. Also, The Beethoven has not any point to climb because there is no rigid bar. The mesh being supple is very difficult to climb up.

With no mechanism or electronics, the Beethoven never breaks down.

We can also offer you a safety cover, however, it must be understood that a cover is above all protection for the pool during winter and that during the summer it’s not practical to open and close the cover 10 times a day to maintain security. Also, the pool water « goes off » with the heat if there is no fresh air. The cover is a security product that we recommand to you essentially for the winter but not the summer
